VORADIAN LAW ENFORCEMENT SUPPORT POLICY

The following applies to Subpoenas, Court Orders, Agency Orders or Search Warrants (“Information Requests”) directed to VORADIAN.

VORADIAN, INC., (“VORADIAN”) provides direct retail end-to-end telecommunications and related services to its business customers and will have information on file regarding end users of telephone numbers. VORADIAN also provides wholesale of telecommunications services to other telecommunications carriers, resellers, and service providers. As a wholesale provider of services, VORADIAN does not have information on file regarding end users of telephone numbers. In most cases, the response to an Information Request concerning a telephone number registered to VORADIAN will include only the name and contact information of the wholesale customer to whom that telephone number is assigned. A separate request must be sent to that carrier, service provider or reseller to obtain subscriber or other information.

CPNI STATEMENT
In compliance with the Federal Communications Commission Order concerning Customer Proprietary Network Information (“CPNI”) and the company’s CPNI Policy, customer information cannot be released without a valid subpoena, court order, search warrant or other formal demand from an agency authorized to request such information.

PEN REGISTER, TRAP AND TRACE, AND WIRE TAP ORDERS
Pen Register, Trap and Trace and Wire Tap Orders are implemented on behalf of VORADIAN by a third-party provider. Upon receipt of a Pen Register, Trap and Trace or Wire Tap Order, VORADIAN will notify the third-party provider who will then contact law enforcement directly to arrange for implementation of the Order.

LEGAL COMPLIANCE FAQs

1. Does VORADIAN charge a fee for Law Enforcement Agencies in criminal investigations to respond to Information Requests?
No. VORADIAN does not charge a fee for Law Enforcement Agencies conducting criminal investigations to respond to Information Requests. However, VORADIAN will not produce the content of e-mail, or other electronic communications as the Electronic Communications Privacy Act, 18 U.S.C. §2701 et seq., prohibits an electronic communications service provider from producing the contents of electronic communications, even pursuant to subpoena or court order, except in limited circumstances.

2. Does VORADIAN charge a fee in any other instances where a court order is issued to respond to information Requests?
Yes.  VORADIAN will charge the person or entity submitting the civil subpoena or court order for costs associated with such compliance. VORADIAN will not produce the content of e-mail, or other electronic communications as the Electronic Communications Privacy Act, 18 U.S.C. §2701 et seq., prohibits an electronic communications service provider from producing the contents of electronic communications, even pursuant to subpoena or court order, except in limited circumstances.

3. What are VORADIAN's fees associated with Information Requests compliance, and where do I make the payment?
Payments associated with compliance of subpoena or court order must be made within ten (10) days from the date of receipt of VORADIAN’s invoice. Check or Money Order shall be made out to VORADIAN, INC. and mailed to: 730 Peachtree Street, N.E., Suite 570, Atlanta, Georgia 30308. Attention: Subpoena Compliance. Payment by Credit Card is not accepted at this time.

Our compliance costs are as follows:
Records and Trace Research: $125.00/Hour (USD) [Minimum 2 Hours Billing]
Federal Express/ UPS Fees: Cost as billed in USD
Copies/ Photo Copies/ .pdf files: $0.50/Page (USD)

4. What is the process for an Exigent Circumstances request?
Exigent circumstances requests will be processed upon receipt of a completed Exigent Circumstances Request Form. The form is available on our website at www.voradian.com or via this link: https://www.voradian.com/legal/law-enforcement-support. For after-hours emergency situations, please contact our Network Operations Center (“NOC”) at 1-866-229-6201 Option 4. The NOC is able to process and respond to after-hours emergency requests. Following the emergency disclosure, law enforcement agencies must follow-up with a valid subpoena, court order or search warrant formally requesting the disclosed information.

5. How will the response to the Information Request be provided to law enforcement?
Responses are provided via email. We request that all Information Requests specify an email address where the response may be sent.

6. Are there any additional requirements concerning civil subpoenas?
Yes. Civil subpoenas shall be served at our registered agent offices located at 2400 Herodian Way, S.E., Suite 220, Smyrna, GA 30080. Upon receipt of a subpoena relating to a civil lawsuit, VORADIAN will notify our customer regarding the subpoena in accordance with our customer notification policy.

7. What is your customer notification policy regarding subpoenas and court orders, and response time?
Upon the receipt of a valid civil subpoena, VORADIAN will promptly notify the customer (s) whose information is sought, via e-mail or U.S. mail or both. If the circumstances do not amount to an emergency, VORADIAN will not immediately produce the customer information sought by the subpoena and will provide the customer an opportunity to move to quash the subpoena in court. VORADIAN reserves the right to charge an administration fee or other fees associated with the compliance of subpoenas and or court orders.
